This refers to the case of Sir Edward Hales, who on 11th Nov 1685 was received into the Catholic Church and was given the command of a Regiment of Foot. This would normally require (in accordance with the Test Act ) an oath of Supremacy and Allegiance. An offender would normally be issued with a fine of £500 but in this instance Hales was brought before Rochester Assizes on the 29th March 1686 where he claimed that he had received letters patent from James II. The basis of this case was really about whether the King had the power to dispense for religious penal laws in individual cases. Found that he had.
